Scotland's Tied Pub Tenants to Receive Long-Awaited Protection with New Code

Monday, April 15, 2024

In a significant move for the hospitality sector in Scotland, ministers have confirmed that secondary legislation for a Scottish Pubs Code will be laid in Parliament this week.

Many tied pub tenants in Scotland have faced challenges due to their business arrangements, often purchasing alcohol and other essential supplies from their landlords.

We need to do all we can to protect pubs, bars, and licensed clubs in Scotland, which in 2022 supported 34,000 jobs throughout the country and play an important role in our communities.

Richard Lochhead

For years, the Scottish Licensed Trade Association, acting on behalf of autonomous pub owners, has campaigned vigorously for the enactment of a Scottish Pubs Code and the approval of the Tied Pubs (Scotland) Bill.

This new code is expected to give tenants more power in negotiating with their landlords, providing fairer business terms and fostering a healthier hospitality industry.

several groups endorsed the law, such as Camra (the Campaign for Real Ale), GMB Scotland, the Federation of Small Businesses, and the Scottish Tourism Alliance.

This comes after numerous complaints from tied pub tenants about being at a disadvantage due to their business arrangements with large pub companies.

The code's implementation is crucial for ensuring a level playing field in Scotland's hospitality sector, with many tenants hoping it will save their businesses and livelihoods.

These new protections in law are vital so tied tenants can make a long-term success of their pubs and shape the unique character of their businesses to become an integral part of their community.

In a show of solidarity with Scotland's hospitality sector, Small Business Minister Richard Lochhead has voiced his support for the upcoming Scottish Pubs Code and Tied Pubs (Scotland) Bill. These initiatives are expected to bring about fairer business terms for tenants and foster a healthier industry. Minister Lochhead acknowledges the substantial impact that local pubs, bars, and clubs have on employment and community life in Scotland, making it essential to address the power imbalance between landlords and tenants.

Despite their staunch resistance, the Scottish Beer & Pub Association (SBPA) persists in expressing concerns over the potential fallout from the implementation of the Scottish Pubs Code and Tied Pubs (Scotland) Bill on the intricate dynamics between landlords and tenants within Scotland's hospitality sector.
